Digital Millennium Copyright Act (DMCA) Compliance

Venture: Orange County complies with the Digital Millennium Copyright Act, 17 U.S.C. §512, and respects the intellectual property rights of others. We review and respond to good-faith notices of alleged copyright infringement using the procedures below. Our Designated Agent is registered with the United States Copyright Office DMCA Designated Agent Directory.

To report a claim of copyright infringement, send a written notice to the DMCA agent. The notice must include all elements listed below.

How to Submit a DMCA Notice

If you believe content on Venture: Orange County infringes your copyright, submit a written notice by email to dmca@ventureoc.com, or by mail to the address in the next section. Email is preferred for faster acknowledgment.

Your notice must include:

  1. Identification of the copyrighted work: Describe the work you believe is infringed (title, author, publication date, or a URL to the original work). If multiple works are claimed, provide a representative list.
  2. Identification of the infringing material: Provide the specific URL(s) or description of the material on ventureoc.com that you claim infringes your copyright. Be as precise as possible.
  3. Your contact information:
    • Full legal name
    • Mailing address
    • Phone number
    • Email address
  4. A statement of good faith belief: Include a statement that you have a good-faith belief that the use of the copyrighted material is not authorized by the copyright owner, agent, or law.
  5. Statement of accuracy under penalty of perjury: Include a statement that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner. The statement should read:
"I declare under penalty of perjury that the foregoing information is true and accurate, and I am authorized to act on behalf of the copyright owner."
  1. Your signature: Include a physical signature (for mailed notices) or an electronic signature (for email notices), such as a typed name, digital signature, or other electronic mark.

Example Notice Format

Use the template below as a starting point. Substitute your own information for the bracketed fields. Submit by email or postal mail to the addresses provided in the next section.

Dear DMCA Agent,

I am [Your Name], the copyright owner of [Work Title] (registered with the U.S. Copyright Office under [registration number, if applicable]).

The following material on ventureoc.com infringes my copyright:

  • Description: [Description of the infringing material]

This use is not authorized by the copyright owner, nor is it permitted under fair use or other applicable law.

Our Response Procedure

Upon receipt of a valid DMCA notice:

  1. We will investigate the claim.
  2. If we determine the notice is valid and complete, we will: promptly disable access to or remove the allegedly infringing material; notify the person who posted the content (if identifiable); and preserve evidence for legal proceedings if necessary.
  3. We will email you to confirm the action taken.
  4. The removal will remain in place pending resolution or further legal action.

Counter-Notice Procedure

If content was disabled or removed based on a DMCA notice, and you believe the claim is erroneous, you may submit a counter-notice.

Your counter-notice must include:

  1. Your identification: Full legal name, address, phone, and email.
  2. Identification of the disabled material: The URL of the removed content or a specific description.
  3. Your statement: A statement made under penalty of perjury that you have a good-faith belief the content does not infringe the copyright (because of a mistake, fair use, or other legal basis).
  4. Reason for the counter-notice: Explain why you believe the removal was improper (e.g., the work is not actually infringing, this constitutes fair use, etc.).
  5. Your consent to jurisdiction: A statement that you consent to the jurisdiction of U.S. District Court for the district where you reside, and that you will accept service of process from the original claimant.
  6. Your signature: A physical or electronic signature.

Our Response to Counter-Notices

Upon receipt of a valid counter-notice:

  1. We will provide a copy to the claimant who submitted the original DMCA notice.
  2. We will give the claimant 10 business days to file a lawsuit or other legal action.
  3. If no legal action is filed within 10 days, we may restore the content.

Please note that filing a counter-notice is a legal declaration made under penalty of perjury. False statements may result in civil and criminal liability.

Repeat Infringement

Users who repeatedly infringe copyright on Venture: Orange County may have their ability to post content disabled or be subject to account suspension or termination.
